1. Eligibility

You must be at least 18 years old to register for an account or otherwise use the Service.

By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the provisions herein.

2. Account Registration

Creating an Account: To access certain features of DatingBooster, you must create an account. You agree to provide accurate and complete information during the registration process and to keep this information up to date.

Account Responsibility: You are solely responsible for all activity that occurs under your account. Please keep your login credentials secure.

Account Security: You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage from your failure to comply with this security obligation.

3. Subscription Plans

General: DatingBooster may offer one or more subscription plans ("Subscription(s)") with varying levels of functionality, features, and pricing.

Billing: If you choose a paid Subscription, you will be charged the subscription fee plus any applicable taxes. You authorize us to charge your chosen payment method for the Subscription.

Cancellation: You may cancel your Subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle unless otherwise specified.

Refunds: Refunds may be granted in our sole discretion and only according to local consumer protection laws that apply, including those relevant within the EU and The Netherlands.

4. Image Uploads

Limited Retention: DatingBooster provides a feature allowing you to upload images. However, images are never stored in our system on a permanent basis.

Usage of Images: By uploading images, you grant us a temporary, non-exclusive, royalty-free license to process those images for the purposes of providing the Service.

User Responsibility: You represent and warrant that you own or have the necessary rights to all images you upload, and that such images do not infringe or violate the rights of any third party.

Compliance: You agree not to upload images that violate local, national, or international laws or that are otherwise inappropriate, offensive, or violate any third-party rights.

5. Prohibited Conduct

You agree not to engage in any of the following actions while using the Service:

• Illegal Activities: Using the Service for any unlawful purpose or to promote illegal activities.
• Harassment: Harassing, threatening, or intimidating other users.
• Misrepresentation: Impersonating any person or entity or otherwise misrepresenting your affiliation with any person or entity.
• Data Mining: Using any robot, spider, or other automated means to access the Service or extract data, except with our express permission.
• Interference: Interfering with or disrupting the Service or servers or networks connected to the Service.

6. Privacy and Data Protection

Personal Data: We handle your personal data in compliance with applicable Dutch and EU data protection laws (including the General Data Protection Regulation, "GDPR").

Image Data: As noted above, images are never permanently stored on our system. We may process them temporarily to provide the Service.

7. Intellectual Property

Our Content: All content, features, and functionality available through the Service, including but not limited to text, graphics, logos, button icons, images (except user-uploaded images), and software, are the property of DatingBooster or its licensors.

User Content: By uploading or posting content to the Service, you grant DatingBooster a limited, non-exclusive, revocable license to display, modify (for technical purposes), and distribute your content solely to provide and operate the Service.

8. Modification and Termination

Changes to the Service: We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice.

Changes to Terms: We may update these Terms from time to time. If we make material changes, we will notify you by posting the revised Terms on our website or within the app. Your continued use of the Service after the updated Terms have been posted constitutes your acceptance of the revised Terms.

Termination: We may, in our sole discretion, suspend or terminate your account at any time if we suspect you are in violation of these Terms or any applicable law.

9. Disclaimers and Limitation of Liability

Disclaimer of Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

Limitation of Liability: To the fullest extent permitted by Dutch law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for all claims related to the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of The Netherlands, unless otherwise required by applicable consumer protection law.

11. Severability

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
